AUSTIN, Texas ? Texas Gov. Rick Perry on Monday asked President Barack Obama to use his executive authority to prevent or delay implementation of stricter pollution standards, saying they will have an "immediate and devastating" effect on the state.

In the letter, obtained by The Associated Press, Perry said the implementation of the Cross State Air Pollution Rules will have an "immediate and devastating effect on Texas jobs, our economy and our ability to supply the electricity our citizens, schools and employers need."

Perry released the letter as he tries to shore up support among conservatives in his bid for the Republican presidential nomination.

The White House said the new standards will save lives.

"We stand behind common sense, vital Clean Air Act protections for public health and clean air," White House spokesman Clark Stevens said. "This rule will prevent over 34,000 premature deaths each year and ensure that American families aren't suffering the consequences of harmful air pollution generated far from home."

The new clean air rules are designed to significantly reduce smog and soot pollution by requiring 27 states, including Texas, to decrease smokestack emissions. The new guidelines apply to sulfur dioxide and nitrogen oxide emissions, which mostly come from coal-fired plants.

Texas has 19 coal-fired power plants ? more than any other state ? and plans to build nine more. It is one of the few states still adding coal-fired plants and releases more air pollutants than any other state. Most other states are building generation plants that use sources other than coal, particularly natural gas.

On Sept. 12, Texas' largest electricity producer, Luminant, said it would shut down two coal-fired power units and lay off hundreds of workers if the new rules were enforced, even after the EPA offered to help the company meet the tougher standards.

"Mr. President, you have recently proclaimed that your administration is committed to creating jobs," Perry wrote. "These rules do not create jobs. They are a job killer in Texas, and they must be stopped."

Texas, faced with a growing population, few new energy sources and hot summers, has been vocal in its opposition to the regulations since they were announced in July. The state has asked a federal appeals court to review the rules.

Perry has used the new rules as fodder in his long-standing accusation that the EPA under Obama meddles in state affairs, lays down expensive regulations during tough economic times and is forcing companies to cut jobs to offset the cost of complying with environmental rules.

Of 10 students who graduated from Cal State Fullerton?s Bachelor of Fine Arts in Theatre Arts program last May, eight received professional jobs to work onstage.?

Situated close to Los Angeles and Hollywood, CSUF is ideally located to send students in the entertainment industry. CSUF?s Performing Arts Department has a highly successful rate of placing its students in industry-related jobs immediately after graduation.

According to the Performing Arts Major?s College Guide, CSUF?s Theatre Arts program is among ?Most Highly Recommended Undergraduate Programs? for drama and musical theater and was listed in ?Noteworthy Programs? for dance.

The department, referred to as the ?Carnegie Mellon of the West Coast? by Musical Theater Coordinator Eve Himmelheber, fosters competition among its students in order to prepare them for the world outside of the Clayes Performing Arts Center walls.

Only the most talented and hardworking students are chosen to be part of the Bachelor of Fine Arts in Theatre Arts program, which is why there is so much competition between students in the Performing Arts Department.

?We start with 125 freshmen who want to be in musical theater, and by the end of sophomore year only 10 students are taken into the B.F.A. program,? said Himmelheber.

The freshmen who come into the program take a placement audition in order to assess whether or not they should pursue one of the 10 B.F.A. spots.

The talent of the students varies. According to Himmelheber, some have been singing since they were young and others performed in one musical and decided that they wanted to pursue it as a career.

The B.F.A. program is different from B.A. programs that other performing arts schools offer because it is highly specialized. According to Himmelheber, the program is a structured program with very intense study in musical theatre.

?Musical theatre (at CSUF) is like a triple major. They have to take acting classes, they have to take voice and movement ? and they have to pass dance juries in three areas: tap, jazz and ballet,? Himmelheber said.

Students in the program receive one-on-one training with voice coaches. They are also required to be in one CSUF performing arts production every semester.

?Undergoing the workload of the B.F.A. program is worth it,? said Undergraduate Coordinator Larry Peters. ?No one is going to come out of B.F.A. program that isn?t a triple threat.?

?The industry knows that when someone leaves our department with a B.F.A., they?ve been vetted all along the way,? he said.

The department?s high regard for its B.F.A. program isn?t all boasting, however. It has the numbers to back it up.

In an industry where 95 percent of performers don?t make a living wage, eight out of the 10 B.F.A. students who graduated last May have professional jobs, six of which are in New York.

The department also provides the B.F.A. students with a showcase in New York before they graduate, where they audition in front of a casting director and, hopefully, get picked up.

Peters offers some insight as to why the program is so successful. ?When you are teaching and creating artists, you begin attracting the best. It?s the combination of the students that we attract and what we bring to them,? he said.

Rose Ouellette, a 2011 B.F.A. program graduate, now performs in New York in Ghostlight, which has sold out its first run.

Both hard work and her training in the B.F.A. program helped her achieve success, said Ouellette.

?I felt prepared to come out here, greatly thanks to Fullerton. Fullerton pushed and challenged me, but these learned lessons and obstacles helped strengthen me as a performer and a person,? said Ouellette.

Ultimately, most students who audition for the B.F.A. program get cut after their sophomore year. These students, who become liberal arts, theatre or dance majors, still find success outside the program.

An explanation for the rest of the department?s success can be found in the sense of community that is found within the department.

Gladys Kares, director of dance for the department, said, ?The alums who?ve gone on to form companies of their own do employ our people.?

Melissa Sakrison, a sophomore and B.F.A. hopeful, recently auditioned for a local production and recognized three B.F.A. graduates there. She recalls how supportive they were of her auditioning.

She points out that no matter who you are, training at CSUF gets people jobs.

?People see that you are trained at CSUF and they respect that,? she said.

The WSOB entry list as of Sept. 22 included players from Australia, Canada, Colombia, Denmark, England, Finland, Germany, Mexico, New Zealand, Poland, Sweden, Venezuela and the United States. Last year?s World Series included 46 players from 14 countries. This year, the PBA expects to exceed both totals and will provide the international bowling community with more than 100 hours of live online coverage of

When the World Series gets underway on Nov. 4, a capacity field of 240 players is expected. Cracker Barrel has found a tidy little formula for releasing music: Package a handful of new songs from an established artist with a few classics and hope loyal fans stop by and maybe sit down for some dumplings or chicken-fried steak.

The Oak Ridge Boys are the latest act to team up with the restaurant-turned-record label, and their new collection of original material and re-recorded hits is a good fit for the Old Country Store. There is plenty of sincerity, a little bit of silly and a whole lot that feels familiar about this project.

Of the five new songs on ?It?s Only Natural,? none is better than the opener, ?What?cha Gonna Do?? Fans get to hear all four parts of that famous harmony, including Richard Sterban?s rumbling ?Whatcha gonna, whatcha whatcha gonna gonna do? hook. ?The Shade? is another great lyric. It?s easy to listen to and provides a great lead up to ?Elvira.?

A few of the re-recordings feel sleepy ? most notably ?Beyond Those Years,? which Joe Bonsall performs more like an adult contemporary radio flop than a country song ? but there are enough smiles on songs like ?Elvira? and ?Gonna Take a Lot of River? to overlook the flat spots. Look for a few surprises as well, like Sterban taking lead vocals on ?Lucky Moon.? It?s a version that really takes a few listens to appreciate.

Watchdog asks Justice to probe ex-SEC official (AP)

WASHINGTON ? The inspector general of the Securities and Exchange Commission has asked the Justice Department to investigate whether a former top SEC official who benefited financially from Bernard Madoff's Ponzi scheme violated conflict-of-interest laws in helping establish SEC policy.

The SEC's former general counsel, David Becker, played a key role in crafting agency policy on how Madoff's victims should be compensated ? after he inherited a Madoff account from his mother.

SEC Inspector General David Kotz said in a report issued Tuesday that Becker participated "personally and substantially" in issues in which he had a financial interest.

Kotz said that on the advice of the federal Office of Government Ethics, he has referred his findings to the Justice Department's Public Integrity Section for possible criminal prosecution.

Kotz also recommended that the five-member SEC vote again on how claims should be paid to Madoff customers "in a process free from any possible bias or taint." SEC Chairman Mary Schapiro said Tuesday she will have the panel vote again.

"I believe that the decision the commission made on that issue was appropriate under the law and in the best interest of investors," Schapiro said in a statement.

Madoff pleaded guilty in 2009 to conducting a multibillion-dollar investment fraud. He is serving a 150-year sentence in federal prison. The SEC's reputation was battered by its failure to detect the Madoff fraud over the nearly two decades the scheme was under way.

Kotz's report said Becker made the case for valuing claims from Madoff customers in a way that could have curbed the power of the federal court-appointed trustee to sue beneficiaries of the scheme ? like Becker ? to recover profits that were deemed fictitious.

The trustee sued Becker and his brothers in February, claiming roughly $1.5 million of the $2 million in their mother's account was phony profit that should be returned to the fund for compensating defrauded Madoff customers.

Schapiro, who asked Kotz in March to investigate the matter, said she takes his report "very seriously."

"I do want to state that I've known David for many years to be a talented, highly skilled lawyer and a dedicated civil servant who served under three (SEC) chairmen," she said.

Dangerous scam causes financial LOSS!

A few months ago, I got caught in this real estate scam.

Fortunately, no one was hurt financially.

Months later, I still hear daily from real estate agents, title agents, real estate attorneys & property owners throughout the country who also have been caught up in this scam?.

Some of these people weren?t so lucky.

Some of these people really did get hurt financially.

Some of these people have refused to speak publicly ? their actions allegedly causing some party to lose money.

When Sarasota?s Michael Haga contacted me the other day, he wanted to know about this real estate scam?how it works & who benefits.

REAL ESTATE SCAM HITS SARASOTA

What is this scam ? Method Of Operation?

1. People presumed to be outside the country are soliciting local agents to submit offers on higher-priced properties, i.e. $500,000+.
2. Scammers submit FAKE (but authentic-looking) cashier?s checks for earnest money (down payment).
3. Scammers? primary interest is to catch escrow agent (either real estate attorney or title agent) breaking their own policies re: release of good faith money/earnest money. For instance, many escrow agents will not refund earnest money (until) funds deposited have cleared or they accept only wired funds. However, it appears not all escrow agents follow such practices or adhere to their own rules. Soon after executing contract b/t buyer and seller, scammer cancels contract, hoping escrow agent (attorney/title agent) will refund deposit before clearing (verifying) funds. You see, these scammers are sending FAKE cashier?s checks for very high amounts, i.e. $500,000+.
4. Further, agents are fronting money for inspections, providing at least once quick out for the scammers as grounds for canceling contract.
5. Sellers are spending money to move out of a house they expect to sell, signing lease agreements and giving deposits ? money they can?t get back. Sellers are NOT getting this money ? scammers receive REAL money in exchange for FAKE cashiers? checks.
6. In some instances and apparently growing, scammers are getting enough information to steal people?s identity.

In a sudden but expected move, scammers now are branching out to target FSBO?s ? for sale by owners who are less informed and fixated on selling. They (FSBOs) don?t see the scam coming?.

First, many people contacting me have refused to go on record to share their experience.

Either they?re embarrassed to admit they were taken in by this scam or they fear damage to their reputation?or worse. In fact, some agents & attorneys contacting me admitted to being sued for their actions.

This is exactly why I chose to go public as I did months ago. How will we STOP this scam if too many people refuse to go public, afraid to admit they were involved or culpable?

Some real estate agents have admitted to being sued by sellers over this scam. A few had admitted to E&O claims/payoffs. I seriously don?t know how this could happen that RE agents are found culpable.

Some real estate attorneys and title agents (or their employees) have admitted to me off record that the attorney or escrow agent violated their own internal policies on refunding deposit money.

It?s time to stop the madness!

Months later, this scam persists, more pervasive than ever before.

Not a day goes by that I don?t received an email, phone call or comment about this scam.

Some people contacting me refuse to comment publicly ? they got burned and they cannot admit or discuss their role in the scam. By ?role,? I am referring real estate agents and escrow agents (both real estate attorneys and title companies holding earning money) who made mistakes and whose actions caused LOSS.

Some real estate agents convinced property owners whose houses they were selling to move out in anticipation of a closing.
Some escrow agents (inc. some attorneys) released earnest money (good faith) deposit before clearing funds first.
Some property owners selling their own houses (aka ?FSBOs?) got duped as well by these scammers crossing the country with this dangerous, costly scam.

Lloyd Chapman: Obama Sneaks Job-Killing, Anti-Minority Small ...

My staff at the American Small Business League (ASBL) and I have spent a week on the phone sounding the alarm about an anti-minority small-business policy proposed by the Obama administration.

Friday, Sept. 9, one day after President Obama announced the American Jobs Act, his administration quietly announced plans to dismantle one of the nation's most successful programs to create jobs in minority communities from coast to coast. The announcement, entered into the Federal Register, stated that the Pentagon, NASA and the U.S. Coast Guard were no longer required to hit a 5-percent contracting goal with small businesses owned by minorities.

This is the kind of typical, non-transparent Washington move that is beginning to define President Obama. It is why I have been telling people for years to stop listening to what President Obama says and start watching what he does. This latest anti-minority small-businesses policy will devastate the minority business community.

Minorities face a difficult enough time as it is. The Labor Department reports that the jobless rate for African Americans alone is 16.7 percent. According to the U.S. Census Bureau, more than 27 percent of African Americans live below the poverty level. Approximately 35 percent of the population is made up of ethnic minorities, and almost 6 million American businesses are owned by minorities.

The ASBL staff and I are going to fight this policy with everything we've got. We've launched a national campaign to inform the media, the public and Congress. We are consulting with our attorneys about possible legal action. Unfortunately, not a single group thought to be representing minority-owned or other small businesses is publicly opposing the policy, though it's not surprising that the U.S. Chamber of Commerce has done nothing.

In addition to dismantling federal contracting programs for minorities, the Obama Administration has been diverting hundreds of billions of dollars in federal small-business contracts to the largest companies worldwide. It's possible that the logic behind dismantling small business contracting programs is that it will make it easier for large companies to receive all federal contracts. Should we expect the Obama Administration to abolish contracting programs for businesses owned by women and service-disabled veterans next?

These programs are the most effective method to create jobs in America. They direct existing federal infrastructure spending to the small businesses that create virtually all net new jobs. The U.S. Census Bureau tells us that small businesses create 90 percent of all net new jobs. Small businesses employ half of the private sector workforce, generate more than half of GDP and are responsible for 90 percent of U.S. exports.

The Obama Administration knows that small businesses aren't sitting around reading the fascinating legal crud that comes out in the back channels of the Federal Register. Small businesses have enough problems dealing with decades of poor economic policies formulated by high-powered, high-funded corporate lobbyists. President Obama owes these businesses (the same ones that helped him get elected) more than a line in the Federal Register.

If I were Barack Obama, the President who promised to lead the most transparent administration in U.S. history, and I had to announce a policy that would put minority-owned companies out of business and cost millions of jobs, I would tell them face-to-face, not in the Federal Register on a Friday.
