Book Review: "Tap Dancing to Work" -- The Latest Buffett Bio : The D ...

In her authorized 2009 biography of American business icon Warren Buffett, The Snowball, ?Alice Schroeder admirably captured how Buffett?s long and successful business career resulted in the?accumulation of not only vast wealth, but also of an impressively?large and loyal network of close friends. Among Buffett?s buddies is Fortune Magazine?s editor-at- large, Carol Loomis. Loomis not only befriended Buffett and his wife, along the way becoming a Berkshire shareholder and an occasional Buffett bridge partner, but also for the last 35 years she has served as the pro bono editor of Buffett?s widely-read and admired annual letter to Berkshire shareholders.

Owing to her unique access to Buffett, Loomis has written a number of perceptive and even revelatory Fortune articles about Buffett. She also provided editorial direction to Fortune colleagues on numerous other articles about Buffett that appeared in the magazine. Many of these articles from the Fortune archives have been collected in a new book, entitled Tap Dancing to Work: Warren Buffett on Practically Everything, 1966-2012. The title is a reference to Buffett?s frequent statement that he enjoys his work so much that he ?tap dances to work ? As befits a book with such an upbeat title, the book is a rousing celebration of Buffett?s?life and business success. (A disclosure statement seems appropriate at this point: I own BRK.B shares, although not merely as many as I wish I did.)

If Schroeder?s book represented a personal biography of Buffett, Loomis?s book is more of a business biography. The Fortune articles about Buffett are arranged essentially in chronological order, as a result of which the book charts the long arc of Buffett?s business life. Buffett himself recently said that ?when you look at Berkshire, you are looking across corporate America.? Reading this book is in many ways a guided tour not only through Buffett?s career and business success, but also through the ebbs and flows of the American business scene over the last four decades.

There is much to commend and admire about this book. Among other things, the book includes several excellent examples of masterful magazine writing. Loomis?s own April 1988 article entitled ?The Inside Story of Warren Buffett? (a version of which can be found here) may be the single best short description available of Buffett and his business philosophy. (Indeed, if you read Loomis?s article, you arguably could dispense with the need the now growing collection of book-length Buffett biographies.)

Loomis?s October 1997 article entitled ?The Wisdom of Salomon?? (a version of which can be found here), about Buffett?s fraught 1991 involvement in the near-collapse of the Salomon Brothers investment banking firm, is a gripping account of perhaps the greatest crisis in Buffett?s long career.

There are also a number of?minor?gems in this book, including a charming 1978 article about how?a still?relatively unknown Buffett helped produce an enormous investment profit for the?endowment?of tiny Grinnell College (on whose Board?of Trustees Buffett served at the time) through a clever and well-timed acquisition of a Dayton, Ohio television station. (The book also reveals that the Grinnell trustees included, during the time that Buffett served on the board, one of the founders of Intel and some guy named Steve Jobs. I have no idea how Grinnell managed to recruit so many corporate titans to its board. I do know that the current value of the college?s endowment is approximately $1.5 billion -- or more than $800,000 for each of the school?s 1,700 students.)

The book also reprints a 1995 book review written by Bill Gates about yet another Buffett biography. Gates?s book review contains an amusing retelling of the occasion in 1991 when Gates and Buffett first met, as well as a touching account of the friendship of the two men. (In an introduction to the Gates piece, Loomis reports that Gates had not wanted to come to the event at which he met Buffett, but was only persuaded to attend after he learned that Washington Post CEO Katherine Graham was going to be there as well. Loomis also reports that while Buffett arrived at the event in the back seat of Post Managing Editor Meg Greenfield?s ?ancient and cramped? Subaru,??Bill and his girlfriend (soon to be wife) Melinda French, arrived more grandly, in a helicopter.?)

Another very interesting feature of this book is how its chronological structure?highlights ?the way earlier events can foreshadow later developments (even though not apparent at the time). For example, Loomis?s riveting account of the Salomon fiasco provides an almost painful premonition of the Lehman collapse 17 years later. And you can?t read the excerpt in the book of Buffett?s 2002 letter to Berkshire shareholders characterizing derivatives as ?weapons of financial mass destruction? without thinking about what happened at AIG just six years later. Indeed, if one were to write a work of fiction with so much heavy-handed foreshadowing, most readers would immediately reject it as hopelessly contrived.

While this book is both enlightening and enjoyable to read, it has its shortcomings. Among other things, even though there were slight mentions of Buffett in the magazine at earlier times (including one April 1966 item that managed to misspell Buffett?s last name), Fortune didn?t write about Buffett as Buffett until the late 70s, and didn?t get around to writing a feature article about him until the early 80s. By that time, Buffett was already in his 50s and by any measure already a phenomenally successful investor and businessman. Simply put, ?other than Loomis?s one article mentioned above, this book lacks a detailed examination of how Buffett got started and how he developed the iron-clad business principles that have guided him ever since.

?

There is another shortcoming with this book?s approach, one that is perhaps an inevitable result of the fact that the book is an anthology of magazine articles written over many decades. Its coverage of Buffett, as thorough as it was, has been episodic and intermittent. Loomis makes up for this somewhat with a running commentary interspersed throughout the book, but inevitably there are gaps. Some of the gaps are huge.

?

For example, there is nothing in the book about Berkshire?s investment in BNSF, by far the largest investment of Buffett?s entire investing career, one that was so large it cost the company its triple-A rating. There is nothing in the book about what I think is one of the most interesting phases of Buffett?s investing career, that is, his opportunistic investment of $15.6 billion in the 25 days of panic that followed the Lehman bankruptcy. There is nothing in the book about the series of unprecedented moves Buffett has made in recent years, including, for example, Berkshire?s?$10 billion investment in IBM (following years of repeated statements that Buffett would never invest in technology because he doesn?t understand it) or Berkshire?s 2010 move to buyback its own shares.

?

And in an omission that is common among all of the various Buffett biographies, there is little in the book about the criminal prosecution of the top officers of what was at the time?the largest Berkshire subsidiary, General Re, owing to a complex, appearances-only transaction between Gen Re and AIG, of which Buffett may well have been aware at the time and with which Buffett may even have been involved.?We don?t know much about whether or not Buffett was involved or not, as to this date no one, especially not Buffett, has provided a comprehensive written account of the events from Buffett?s perspective. (More disclosure: During the relevant period, I worked at a subsidiary of Gen Re.)

In addition, one of the great strengths of the magazine?s coverage of Buffett ? that is, Loomis?s privileged access to Buffett -- may also be another of the book?s shortcomings. By her own admission, Loomis is not objective about Buffett. Her biases are well-disclosed ? she describes herself as Buffett?s ?close friend.? Over the years, Loomis controlled much of the magazine?s content about Buffett, either by writing it herself or by managing the editorial process of others? articles. The result is that some of the magazine?s Buffett coverage, especially when read in quick succession?as this book?s format requires, starts to feel like hagiography.

?

In short, while I think this new book is great and I have no trouble recommending it, in my view, the quintessential Buffett business biography still has yet to be written. I will say that for anyone interested in getting a handle on Buffett?s investing philosophy and business approach, as well as on the early days of his business career, the best bet may be Roger Lowenstein?s 1995 bio entitled Buffett: The Making of an American Capitalist. Indeed, the Bill Gates book review I mentioned above was written about Lowenstein?s book, of which Gates said ?until Warren writes his own book, this is the one to read.?

I have managed to get this far in my review of Loomis?s book about Buffett without mentioning what is by far its best part ? that is, the numerous pieces written by Buffett himself that are interspersed throughout the book. One of the most interesting items is an article Buffett wrote for the magazine in May 1977 entitled ?How Inflation Swindles the Equity Investor? (a version of which appears here). ?I had not previously read this article, but it may be the single best piece I have ever read encapsulating Buffett?s conception of equity investing. It also reflects a detailed and edifying analysis of the dangers economic inflation poses, a theme to which Buffett has returned time and again over the years (including his provocative essay in his 2011 letter to Berkshire shareholders about investing in gold).

The fact that the best parts of this book are the ones that Buffett himself wrote suggests that the optimal approach to trying to understand Buffett may be to just cut to the chase and read Buffett?s own personal anthology, in the form of his annual letters to Berkshire shareholders. Thirty-five years? worth of the letters is freely available on Berkshire?s website, here. My own analysis of the most recent years? letters, along with my other writings about Buffett, can be found here.

Some readers may well find it a daunting task to try to work through hundreds of pages of the shareholder letters. Here?s a secret: there is a shortcut. George Washington Law School Professor Lawrence Cunningham has compiled an indexed, thematically arranged anthology of Buffett?s writings in a splendid book entitled The Essays of Warren Buffett: Lessons for Corporate America, the most recent edition of which can be found here. As I noted in my review of an earlier edition of Cunningham?s book, here, ?Cunningham has done a masterful job distilling Buffett?s writings and organizing them according to topic. This arrangement not only facilitates a quick reference to Buffett?s comments on any given topic, but it also provides insight into how Buffett?s views on the topic may have evolved over time.?

The Wit and Wisdom of the Sage of Omaha: One of the great pleasures of reading (or just reading about) Buffet?s various essays is his gift for the homey aphorism, often told with great humor. Loomis?s book captures a few of the good ones, including Buffett?s own summary of his experiences running (and saving) Salomon: ?I felt like the drama critic who wrote, ?I would have enjoyed the play except that I had an unfortunate seat. It faced the stage.??

Loomis also recounts some career advice Buffett gave to an audience of University of Washington business school students: ?I?d advise you when you go out to work , work for an organization of people you admire, because it will turn you on. I always worry about people who say, ?I?m going to do this for ten years. I really don?t like it very well. And then I?ll do this?? That?s a little like saving up sex for your old age. Not a very good idea.?

?

Some of my favorite Buffet anecdotes appear in his letters to Berkshire shareholders. In his 1986 letter, he wrote about the tailor who went to see the Pope, whose friends asked him what the Pope is like. Buffett writes that ?our hero wasted no words: ?He?s a forty-four medium.?? Another favorite is the story about the man who asked his vet what to do for his horse that limped sometimes but seemed fine at other times. Buffett states that ?the vet?s reply was pointed: ?No problem ? when he?s walking fine, sell him.??

My own personal favorite, from the 1985 letter, is one that I have quoted previously on this blog, but I like it so much, I am reproducing it again here:

?

An oil prospector, moving to his heavenly reward, was met by St. Peter with bad news. ?You?re qualified for residence?, said St. Peter, ?but, as you can see, the compound reserved for oil men is packed. There?s no way to squeeze you in.? After thinking a moment, the prospector asked if he might say just four words to the present occupants. That seemed harmless to St. Peter, so the prospector cupped his hands and yelled, ?Oil discovered in hell.? Immediately the gate to the compound opened and all of the oil men marched out to head for the nether regions. Impressed, St. Peter invited the prospector to move in and make himself comfortable. The prospector paused. ?No,? he said, ?I think I?ll go along with the rest of the boys. There might be some truth to that rumor after all.?

Suu Kyi decries crackdown that injured protesters

MONYWA, Myanmar (AP) ? Opposition leader Aung San Suu Kyi has publicly criticized the forcible crackdown on protesters at a mine in northwestern Myanmar, saying the public needs an explanation of the violence that injured dozens, including Buddhist monks.

More than 10,000 people heard Suu Kyi speak Friday morning in a nearby village about the Letpadaung copper mine.

Protesters say it is causing environmental and social problems and occupied the project for 11 days before the crackdown.

Police used water cannons, tear gas and smoke bombs early Thursday to disperse the protest. Their weapons caused severe burns to protesters and set their makeshift shelters ablaze.

A nurse at a Monywa hospital said 27 monks and one other person were admitted there to be treated for burns.

UK November consumer morale rallies to 18-month high

LONDON (Reuters) - British consumer confidence unexpectedly picked up to an 18-month high in November, according to a survey on Friday that offered Chancellor George Osborne some relief before he sets out his plans to revive a stagnant economy next week.

The GfK NOP headline index rose to -22 from -30 in October, the strongest since May 2011 and better than forecasts for an unchanged reading.

Although Britain's economy emerged from recession in the third quarter, policymakers have warned of a slow and drawn-out recovery. Under pressure to do more to find growth, Osborne will update parliament on his budget plans on December 5.

Austerity measures, weak wage growth and high inflation have darkened the outlook and reduced families' willingness to spend. However, the latest survey suggested the mood of consumers may be slowly improving.

"This is an unexpected rise in consumer confidence," said Nick Moon, GfK's managing director of social research. "The improvement is especially dramatic following such a stagnant summer."

The next few survey results will show whether November's figure was a spike or the start of a positive trend, he added.

A separate survey on Thursday by the Confederation of British Industry, a business lobby group, said retail sales rose in November at the fastest pace in five months.

However, the latest official data was more downbeat. The statistics office said on November 15 that October's retail sales were the weakest since April.

The GfK breakdown showed Britons were more upbeat about their personal finances, while their optimism for wider economy over the year ahead was the strongest since May 2011. Their appetite for making big purchases also improved.

Researchers polled 2,001 people from November 2 to November 11 on behalf of the European Commission, the EU's executive body.

Meat Allergy Reaches Regions Without Ticks

Experts aren't sure why a meat allergy linked to tick bites is reaching areas beyond the tick range. Gretchen Cuda Kroen reports.

Ticks are bad news.? They spread Lyme disease and Rocky Mountain Spotted Fever. And they?re also responsible for an unusual food allergy?to meat. Yup, get bit by one of these buggers and it could be bye-bye BBQ.

The strange allergy has been linked to the particularly aggressive Lone Star Tick. These tiny ticks are found primarily in the Southeastern United States, the same place as most of the known cases of the meat allergy. Or so it seemed.

Researchers from Viracor, a company offering a diagnostic test for the allergy, found that the allergy is also appearing in places without the ticks?as far away as Hawaii. Experts aren?t entirely sure why. The ticks may be spreading, the allergy can possibly be triggered by other tick species or people are frequently getting bitten while traveling. The data was presented at the meeting of the American College of Allergy, Asthma and Immunology.

The bottom line? Regardless of where you live, if you?re going to be outdoors and you love meat, get out the DEET.

Oil below $87 after OECD cuts growth forecasts

BANGKOK (AP) ? The price of oil fell below $87 a barrel Wednesday after the Organization for Economic Cooperation and Development cut its growth outlook for the U.S. and the 17 countries that use the euro currency.

Benchmark oil for January delivery was down 23 cents to $86.96 per barrel at late afternoon Bangkok time in electronic trading on the New York Mercantile Exchange. The contract fell 56 cents to finish at $87.18 a barrel on the Nymex on Tuesday.

The Paris-based OECD said Tuesday that the combined economy of the 17 euro countries will contract by 0.4 percent this year, worse than May's 0.1 percent forecast. For 2013, it will contract a further 0.1 percent.

The OECD also downgraded its forecasts for the U.S. economy. Even if the White House and Congress strike a budget deal before Jan. 1 and avoid the so-called fiscal cliff of automatic tax hikes and spending cuts, the OECD said the U.S. will grow by only 2 percent next year, down from May's forecast of 2.6 percent.

Traders said weak economic growth would likely hurt demand for energy.

Michael Hewson, senior market analyst of CMC Markets, said the OECD report refocused concerns on "the toxic effect the European crisis continues to have on global growth prospects."

Brent crude, which is used to set prices for many international varieties of oil, fell 28 cents to $109.59 a barrel on London's ICE Futures exchange.

In other energy futures trading on the Nymex:

? Wholesale gasoline was down 0.3 cent at $2.692.

? Natural gas fell 2 cents to $3.749 per 1,000 cubic feet.

? Heating oil fell 0.2 cent to $3.023 a gallon.

Tech Toolkit: Computer forensics brings more robust security ...

The sales employee you?ve just hired is a dream come true: Not only were her references excellent, but she also comes with an extensive list of qualified leads that can jumpstart your business toward more growth and competitiveness.

This is around the time your sense of foreboding should kick in.

?We?ve seen a big uptick in this area, where a company that?s hiring is in for a nasty surprise,? says Jeremy Wunsch, CEO at Minneapolis-based LuciData, a computer forensic services company. ?They bring on a seemingly great employee, and a few weeks later, they?re hit with an intellectual property theft lawsuit.?

The reason for an increase in litigation is that more companies of every size are realizing that there?s a way to protect their data from being misused, and that strategy is computer forensics, Wunsch said.

Following every data-based rabbit hole

In a very basic sense, computer forensics (sometimes known as digital forensics because mobile technology is covered) involves searching through digital assets, and if there?s a court case involved, the results of that search become e-discovery.

Although both are geared toward finding information that?s relevant to a lawsuit, the strategy can be used even when there?s no litigation. Forensic investigators follow every data-based rabbit hole in an organization and look for evidence of wrongdoing, depending on a client?s main concern.

For example, a CEO might be worried about employees forwarding offensive ?jokes? to other departments, creating fertile ground for harassment claims. A computer forensics specialist can find those email threads, even if they?ve been deleted, and pinpoint the source of the issue. Or there may be concerns about whether a network issue has exposed customer information, including credit card data or enterprise banking information.

Using highly sophisticated tools and detection methods, computer forensic professionals can ferret out usage logs and even determine what company information has passed onto thumb drives, cloud-based data storage applications and home computers.

Focus on internal threats

Increasingly, companies are recognizing the value of using computer forensics as a preventive measure rather than damage control.

?Sometimes, there?s just concern about a certain piece of intellectual property, like a design for a particular product,? says Paul Luehr, managing director of the Minneapolis office of Stroz Friedberg, a digital risk management firm headquartered in New York. ?By looking for any communication or data about that design, we can discover whether it?s been leaked, or could be.?

In doing those types of investigations, computer forensic specialists are often able to find security flaws within a system. That insight can be invaluable for a company, adds Wunsch.

?If you don?t have the right safeguards in place, especially for internal threats, it can be an expensive security risk,? he says. ?We?re seeing a big push in that direction, with companies asking us to come in and look at their systems to detect any intellectual property movement from inside to outside the organization.?

Internal threats can be a company?s greatest liability. Many enterprises worry about security risks like hackers, when they should be more concerned about whether an employee is taking home files on a thumb drive. Computer forensics helps to minimize these risks, Wunsch says, because an investigation can detect that sort of activity and install the security to keep it from happening again.

Making the case in court

Although computer forensics can help a company to prevent issues that lead to lawsuits, the most common application is when a suit is actually in progress. The benefit to using a specialty firm like LuciData, Stroz Friedberg or Minnetonka-based Computer Forensic Services comes with interpretation of search results, says Luehr.

?Forensics isn?t just firing a tool at a hard drive and coming up with a magical result,? he says. ?You also need someone with extensive experience in presenting evidence in court, and who understands issues like evidence preservation.?

Those abilities are crucial because judges are increasingly involved in the nitty-gritty details of e-discovery, adds Michele Lange, director of discovery at Kroll Ontrack, an Eden Prairie-based provider of data recovery and legal technologies.

?Looking ahead, I think courts will have higher expectations when it comes to e-discovery, they?ll want to know more details,? says Lange.

Because so much data is going toward a digital format, she predicts that there might come a time in the near future when technology is used for almost all court documentation. That?s bad news for office supply companies, perhaps, but good news for computer forensics and e-discovery specialists.

?Three to five years from now, document review will look very different than it does now, even in small law firms,? Lange says. ?Technology-assisted review is about to explode.?

For both litigation and enterprise operations, it?s likely that computer forensics will be used more by companies of every size in addition to law firms.

?There?s a great deal of value that businesses can get from computer forensic services ? from employment protection to data security,? Luehr says.

Ericsson sues Samsung for patent infringement

STOCKHOLM (Reuters) - Ericsson, the world's biggest telecom network equipment maker, said it was suing Samsung Electronics Co for patent infringement after two years of talks failed to yield a license agreement.

Sweden's Ericsson, which reckons more than 40 percent of the world's mobile traffic passes through its networks, filed a lawsuit in the United States saying Samsung had refused to sign a license to use technology on terms it referred to as fair, reasonable and non-discriminatory (FRAND).

"Ericsson has tried long and hard to amicably come to an agreement with Samsung and sign a license agreement on FRAND terms. We have turned to litigation as a last resort," Kasim Alfalahi, chief intellectual property officer at Ericsson said in a statement on Tuesday.

Alfalahi noted Ericsson has over 30,000 patents and more than 100 license agreements with major players in the industry.

A surge in smartphone and tablet computer sales has driven a switch in traffic on telecoms networks from mainly voice calls to video and music, which take up more capacity.

But although data traffic is surging - smartphone subscriptions alone are expected to rise to 3.3 billion by 2018 according to Ericsson's own figures - operators are finding it hard to get customers to pay much extra, squeezing their profits.

With Ericsson suffering a big drop in sales at its network unit - down 17 percent in the third quarter - it is increasingly turning to the courts to maintain its patent income, part of a wider trend where big technology names are fiercely protecting their intellectual property as global sales of tablets and smartphones boom.

One lawsuit by Apple relating to patents resulted in a $1.05 billion jury verdict against Samsung, the world's largest cell phone and television maker, in August.

An Ericsson spokesman declined to comment on the size of its lawsuit.

Samsung said it will "take all necessary legal measures to protect against Ericsson's excessive claims."

"Samsung has faithfully committed itself to conducting fair and reasonable negotiations with Ericsson over the past two years, but Ericsson has demanded prohibitively higher royalty rates to renew the same patent portfolio," the South Korean company said.

FRAND

Samsung is also embroiled in a legal war with Apple in more than 20 disputes in 10 countries, with Apple alleging various Samsung smartphone and tablet products infringed its patents.

"Ericsson now has plenty of material from Samsung's litigations with Apple to quote in support of high FRAND royalty rates and sales bans," said Florian Mueller, blogger and patent expert who has advised Microsoft and Oracle in the past.

The Ericsson dispute concerns patented technology the Swedish firm says is essential to several telecommunications and networking standards used by Samsung's products as well as other patented inventions that are frequently implemented in wireless and consumer electronics products, the company said.

FRAND licensing terms are used for patents and technologies that have become essential, often as an industry standard. Ericsson says its FRAND licensing aims to give companies the incentive to contribute technology to open standards and still maintain royalty rates at a reasonable level. But the growth of patent suits has added complication to FRAND licensing and some tech companies have complained of inflated prices being proposed by patent owners.

According to Ericsson's statement, the company spent $5 billion in 2011 on research and development that resulted "in hundreds of patented inventions that are essential to the standards that drive global communications," such as GSM, GPRS and EDGE.

Ericsson's intellectual property right net revenues amounted to 6.2 billion Swedish crowns ($938 million) in 2011.

The complaint is filed in the District Court for the Eastern District of Texas, the district where Ericsson's U.S. headquarters is located.

ISTANBUL -- An autopsy on the exhumed body late President Turgut Ozal, who led Turkey out of military rule in the 1980s, has revealed evidence of poisoning, a Turkish newspaper reported Monday.

There had long been rumors that Ozal, who died of heart failure in 1993 at the age of 65, was murdered by militants of the "deep state" -- a shadowy nationalist strain within the Turkish establishment of the day. He had angered some with his efforts to end the Kurdish conflict and survived an assassination bid in 1988.

His body, dug up last month on the orders of prosecutors investigating suspicions of foul play in his death, contained the banned insecticide DDT and the related compound DDE at ten times the normal level, Today's Zaman cited sources from the state Forensic Medicine Institute as saying.

"Ozal was most likely poisoned with four separate substances," the paper reported the sources as saying, also naming the toxic metal cadmium and the radioactive elements americium and polonium as substances found in Ozal's remains.

Forensic institute officials declined to comment.

Dominant figure in Turkish politics in 1980s
Ozal, whose economic reforms easing the grip of the state on business helped shape modern Turkey, was in poor health. After undergoing a triple heart bypass operation in the United States in 1987, he kept up a grueling schedule and remained overweight until he died.

His moves to end a Kurdish insurgency and create a Turkic union with central Asian states have been cited as motives for would-be enemies in "deep state," in which security establishment figures and criminal elements colluded.

It was Turkey's military leaders who appointed him as a minister after a period of military rule following a 1980 coup.

He went on to dominate Turkish politics as prime minister from 1983 to 1989. Parliament then elected him president, but those close to him believe his reform efforts displeased some in the security establishment.

While prime minister, Ozal survived an assassination attempt by a right-wing gunman in 1988 when he was shot at a party congress, injuring a finger.

Frequent coups
Turkish political history has been littered with military coups, alleged anti-government plots and extra-judicial killings. A court is currently trying hundreds of people suspected of links to a nationalist underground network known as "Ergenekon" accused of plotting to overthrow the government.

A media report at the start of November said Ozal's autopsy had revealed high levels of the pesticide strychnine, but the ATK subsequently denied the report.

The head of the Forensic Medicine Institute?has said it aims to complete its work in December and that its report would be handed over to prosecutors.

Apple had to purchase the "Lightning" trademark from Harley Davidson, in order to name its new tiny charger on the iPhone 5 and other iOS devices,?reports Patently Apple.

The news comes from the EU Patent & Trademark Office, which published two trademark applications for Apple's Lightning connector.

Apple doesn't own the trademark entirely though. It was approved for a partial transfer, which?Gizmodo?speculates to mean that Harley Davidson can still use the Lightning trademark for motorcycle-related products.?

Harley Davidson's previous trademark covered not only motorcycles, motorcycle electrical parts, protective helmets and turn signals but also TVs, computer game programs, and eye glasses.

Israel, Hamas teams in Cairo for more truce talks

CAIRO (Reuters) - Egyptian mediators began separate talks on Monday with Hamas and with Israel to flesh out details of a ceasefire agreed last week that ended eight days of fighting in the Gaza Strip.

An Egyptian official told Reuters the talks would discuss Palestinian demands for the opening of more Israeli crossings into Gaza - a move that would help end six years of blockade of the coastal enclave ruled by the Islamist Hamas.

The Egyptian-brokered ceasefire came into force last Wednesday, ending hostilities between the two sides that cost the lives of 167 Palestinians and six Israelis.

However, the text of the truce stipulated that issues such as access to the borders, free movement for Gazans and the transfer of goods would be dealt with "after 24 hours".

Israel imposed restrictions on Gaza in 2006, following an election victory by Hamas, which refuses to recognize Israel's right to exist. The curbs were tightened, and backed by Egypt, after Hamas seized control of the enclave in a civil war.

Some of the import and export limits have since been eased, but Israel still prevents a long list of goods into the territory - including many items needed for construction - arguing they could be used for the manufacture of weapons.

Senior Hamas leader Mahmoud Al-Zahar told reporters on Saturday that the group wanted to see the opening of all four goods crossings with Israel that used to operate before 2006.

Only one operates at present, with a second passenger terminal reserved for the handful of Palestinians and foreigners who are allowed in and out of the territory.

The Egyptian official said Cairo would also urge both sides to cement their commitments to the ceasefire agreement.

Israeli soldiers shot dead a Palestinian man on Friday after he approached the Gazan "no-go" border area, apparently in the belief that under the terms of the ceasefire deal he was unable to go up to the heavily patrolled fence.

Alarmed by the prospect of the truce failing, Egypt encouraged Hamas police to be deployed along the border line to keep Gazans away and prevent further violence.

A day later Israeli troops avoided interfering when Gaza farmers neared the fence to tend to their land, and Israel also eased its restrictions at sea, permitting Gaza fishermen to head farther away from the coast than in the past three years.

Israel launched its air offensive against the Gaza Strip on November 14 with the declared aim of deterring Islamist militants from firing rockets into its territory.

The Israeli military also says its soldiers have come under increasing attack from the border area this year, including earlier this month when a jeep was hit by an anti-tank missile.

U.N. Secretary-General Ban Ki-moon told an Austrian newspaper in remarks due for publication on Tuesday that "the most important thing right now is ensuring that there are no illegal deliveries of rockets and weapons to Hamas" and "free access and freedom of movement in Gaza".

Ban thought the Gaza crisis also showed "the status quo is no option" and urged a resumption of Israeli-Palestinian peace talks stalled since 2010, though Hamas has had no role in those negotiations as it rejects any recognition of Israel.

Google Voice updated for iPhone 5, iOS 6. Still ugly.

Google Voice has just been updated to support iOS 6 and the iPhone 5's 16:9 screen -- which, hey, is faster than Apple's Keynote remote app, right? -- and to fix some bugs.

Not fixed is the interface, which is still in Google's horrific, old-school design style. Which actually goes to show how much work and how greatly improved apps like Google+ and Gmail have received. Google is pushing their new "beautiful" design aesthetic on the web, in Android, and in iOS. Google Voice has to get some love at some point.

Then again, we don't hear much about Google Voice on iOS anymore... anyone still using it?
