Philadelphia Workers Compensation Lawyers:"Statutory Employer ...

Posted on 08/14/12 07:08 pm

On May 29, 2012 the Supreme Court of Pennsylvania issued a decision, finding that a General Contractor is liable for payment of Workers? Compensation benefits, when an employee of an independent subcontractor suffers injuries in the course of their employment, and the subcontractor did not carry Workers? Compensation insurance, even if the injury did not occur on the contractor?s premises. This decision expands the definition of ?statutory employers? for the benefit of workers injured in the course of their employment, and imposes a duty upon general contractors to ensure that their subcontractors comply with Pennsylvania law requiring appropriate insurance coverage. The Court expressed the? purpose of the Pennsylvania Workers? Compensation Act is to compensate workers injured in the course of their employment, and it?s terms must be liberally interpreted to benefit those injured workers.
